A man from Barking has been found guilty at court for breaking his Section 80 Noise Abatement Notice and ordered to pay over £3,000 at court.
Mr Felix Mateus Fernande Da Cruz was issued the Notice by Barking and Dagenham Council’s Environmental Enforcement Officers on 14 November 2023 for excessive amplified music and shouting from his property.
On 14 August 2024, council officers received several complaints from neighbours about Mr Cruz of Mill Point, Barking.
Officers attended and deemed the noise coming from Mr Cruz’s property to be unnecessarily loud and a breach of the Noise Abatement Notice.
As a result, Mr Cruz was prosecuted at Barkingside Magistrates Court on Tuesday 5 November.
In his absence, he was found guilty and ordered to pay a fine of £1,200, Costs to Barking and Dagenham Council of £1,359.14 and a Victim Surcharge of £280, totalling £3,039.14.
The case was also picked up by the council’s Antisocial Behaviour Team on behalf of Reside and a Closure Order was issued on the property for three months on Friday 8 November. This means the premises is closed and if a person remains or enters the premises during the three-month period, they’re committing an offence and are liable to imprisonment of three months or a fine (or both) if convicted.
Councillor Syed Ghani, Cabinet Member for Enforcement and Community Safety said: “The measures taken against Mr. Cruz underline our dedication to upholding noise regulations and safeguarding the well-being of our community. We will persist in tackling such issues.”
